Refund on Advance made to Housing cooperative society for non adherence to initial guidelines
I had applied for an residential site in Nov 2007 in Gnanaganga Housing Cooperative society, MYSORE. The society had committed for conversion of some land to sites and make allotment within 3 years from the date of receiving the money. The site value was 2.50 Lacs with an incremental value of approximately 5-10% at the time off allotment. The tenure is now on the verge of completion and the Housing society has only purchase land for about 75% and yet to apply for the approval to Mysore Urban Development authority(MUDA).

There was an AGM for the 2nd year which happened in March 2010. The outcome of the AGM was that, there was an increase in the incremental value by whopping 60% for reason the society claims that, they had wrong estimation of the plan and the cost, which is absurd. From 2.50 Lacs the site value is now 4.00 Lacs, which many applicants had raised contention. The President Mr. Rajeev had promised to refund the advance for those who are not interested in the project. Few have applied and iam being one of them.

Despite the promise made, my application for refund is yet pending. Mr. Sharma who is one of workers of this society says, you cannot do anything via., legal action since there should only be very strong reason for refund of such claims. So he asks to wait for time which the society has no commitment towards.

Can i get any justice for this... Iam thinking to move to consumer court. Is thier any other way to get rid of this and sue this cooperative society.
